Privacy Policy
Last Revised on October 7, 2026. This version replaces the policy dated January 21, 2025.
Our Commitment to Online Privacy
At ATX Interior Design LLC DBA Living Oak ("Living Oak," "we," "us," "our"), we care about your online privacy ("you," "your," "user"). This Privacy Policy (the "Policy") explains what information we collect through our Online Services, how we use and share it, and the choices you have.
This Policy is subject to our Terms of Use Agreement (the "Terms"), posted on our websites. The Terms contain provisions, including mandatory binding arbitration and a class action waiver, that materially affect your legal rights, including your right to bring a lawsuit against us. You should read the Terms in addition to this Policy.
By continuing to use our Online Services, you agree to the collection and use of your information as described in this Policy.
Services This Policy Covers
This Policy applies to the online services owned and operated by ATX Interior Design LLC DBA Living Oak, including:
- livingoak.com, the website of Living Oak Interior Design;
- livingoakhome.com, the online store of Living Oak Home, including customer accounts and checkout;
- our social media accounts and our email communications; and
- any future online services we develop
(together, the "Online Services").
Purchases from our online store are also governed by the store policies posted in the footer of livingoakhome.com, including our refund policy, shipping policy, and cancellation policy. Our interior design services are governed by separate client service agreements provided when you engage us for those services.
Services This Policy Does Not Cover
Our Online Services contain links to websites and services we do not own, including partner websites, retailers reached through affiliate links, and social media platforms. When you click one of these links, you leave our Online Services and this Policy no longer applies. We are not responsible for the content, privacy policies, or practices of any third party website or service. When you interact with our Online Services through a third party platform such as Google, Instagram, Facebook, Pinterest, or TikTok, you also agree to that platform's own policies, and this Policy is in addition to, not in place of, those agreements.
What Is Personal Information?
"Personal Information" is any information that may allow an individual to be personally identified. Examples include your name, email address, phone number, residential or shipping address, and payment card details. Other information, such as your IP address, device identifiers, geolocation, order history, interests, or job title, may also be Personal Information when it is combined with other information in a way that reveals your identity.
Personal Information We Collect
Information you provide directly. We collect Personal Information you choose to give us, for example when you submit a contact or discovery call form, join our email list, create an account on our online store, place an order (including your name, email address, phone number, billing and shipping address, and the items you ordered), request customer service, sign up for an event, or comment on or message our social media accounts. Comments you post publicly on social media are visible to others. When you provide Personal Information, you permit us to use it to fulfill your request and for our legitimate business purposes described in this Policy.
Payment information. Payments on our online store are processed by Shopify and its payment partners, including digital wallet providers. We do not receive or store your full payment card number. We receive order details and the limited billing information needed to fulfill your order, process returns, and prevent fraud.
Information collected automatically. When you use our Online Services, we and our service providers automatically collect information such as your IP address, browser and device type, approximate location, pages viewed, click activity, and how you reached our sites. Our online store runs on Shopify, and our websites use hosting and site platforms that collect visitor and traffic data as part of operating the sites. We also use analytics and advertising tools that may include Google Analytics and tools from Meta (Facebook and Instagram) and Pinterest. We use much of this information in aggregated form to understand traffic and improve our Online Services. However, some of it can identify you or your device, particularly when combined with information you provide, for example when you submit a form or place an order. We may also be legally required to provide information to law enforcement or regulatory authorities.
Passwords and Store Accounts
Customer accounts on our online store are hosted and secured by Shopify. We never see or store your password. Passwords for social media and other third party platforms are administered entirely by those platforms, and we do not have access to them.
Cookie Policy
Cookies are small files placed on your device through your browser when you use our Online Services. We use both session cookies, which are erased when you close your browser, and persistent cookies, which stay on your device for a set period or until you delete them.
Why we use cookies. Cookies keep core features working, such as the shopping cart, checkout, staying signed in to your store account, and fraud prevention. They also give us insight into how our Online Services are used, such as visitor counts, device types, how visitors found us, and general geographic areas, and they support our advertising. We may advertise through Google, Meta (Facebook and Instagram), and Pinterest, and those platforms use cookies and similar technologies to measure our ads and to show our ads to audiences likely to be interested in Living Oak. That is why you may see paid or sponsored posts from us on those platforms.
Blocking cookies. Most browsers let you block cookies entirely or block certain types. If you block cookies, parts of our Online Services may not work correctly, including the shopping cart and checkout. To opt out of targeted advertising specifically, you can use these links:
- Facebook: https://www.facebook.com/settings/?tab=ads

You can learn more about cookies at https://www.allaboutcookies.org.

- process payments and prevent fraud and misuse of our Online Services;
- maintain your store account and order history;

- personalize content and improve, monitor, and test our Online Services and new offerings;
- understand who uses our Online Services and reach audiences likely to be interested in them;
- allow you to contact us and participate in our Online Services and events;
- comply with law enforcement and other regulatory authorities; and
- fulfill or enforce our Terms and any contract you have entered into with us.
Affiliate Links
Our Online Services, including our blog, emails, and social media content, may include affiliate links to products sold by independent retailers. If you click an affiliate link, the retailer or the affiliate network may use cookies or similar technologies to attribute your visit or purchase to us, and we may earn a commission at no additional cost to you. Purchases made through affiliate links happen on third party websites under their own privacy policies and terms. We do not receive your payment information from those purchases, though we may receive limited or aggregated reporting about activity generated through our links.
Sharing Personal Information with Third Parties
We limit who we share your Personal Information with, but some sharing is necessary to run our business. We may share Personal Information in the following ways:
Service providers and agents. We use trusted companies to help us operate, including our website hosting provider, our store platform Shopify, payment processors, shipping carriers and fulfillment partners, email marketing tools, analytics and advertising platforms, and other software we use to run the business. These providers may access Personal Information only as needed to perform services for us and must handle it consistent with our privacy practices.
New owners. If we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, Personal Information may be sold or transferred as part of that transaction.
Law enforcement and legal obligations. We may share Personal Information when we believe in good faith that sharing is necessary to protect our business, our clients, or our customers, or when we are required to do so, for example under a warrant or subpoena, to report fraud or misuse of our Online Services, or when property or safety is at risk. In fraud cases, we may also share Personal Information with investigatory authorities and banks.
Email Policy
Marketing emails you can opt out of. If you receive marketing emails from us, it is because you signed up or otherwise agreed to receive them. You can opt out at any time by clicking unsubscribe in any marketing email.
Service emails you cannot opt out of. While you do business with us, we send certain emails you cannot opt out of, such as order confirmations, shipping notices, account notices, updates to this Policy, and, in the unlikely event of a security breach, breach notifications.
Personal Information Retention and Your Rights
We keep Personal Information only as long as needed to provide our Online Services, fulfill the purposes described in this Policy, and meet our legal, tax, and accounting obligations. Order and transaction records are retained as required for those obligations.
Depending on where you live, privacy laws such as the Texas Data Privacy and Security Act, the California Consumer Privacy Act, or the EU General Data Protection Regulation may give you rights to:
- access the Personal Information we have about you;
- learn the categories of third parties we have shared it with;
- correct Personal Information that is inaccurate;
- delete your Personal Information from our systems;
- transfer your Personal Information to another service, where technically feasible; and
- withdraw consent you have given us for specific uses.
Regardless of whether a particular law applies to us, you can contact us using the information at the end of this Policy to make any of these requests, and we will make reasonable, good faith efforts to honor them. In some cases we may be required to retain information to comply with administrative, legal, or regulatory obligations, such as tax records or fraud prevention. We also reserve the right to anonymize your data by removing identifying details rather than delete it completely.
Where Your Personal Information Is Processed and Stored
We are a business formed and operated in the United States. Our websites, store, and other tools are hosted by third party providers, including Shopify and our website hosting provider, which may store or process information on servers inside and outside the United States. In certain situations, courts, law enforcement agencies, regulatory agencies, or security authorities in those countries may be entitled to access your Personal Information under their laws.
Third Party Software, Apps, and Services
We use our best efforts to pick reputable third party platforms, software, and services. However, we do not control these third parties and are not liable for any breach of privacy or data security that occurs due to their fault.
Keeping Your Personal Information Safe
We have physical, electronic, and managerial safeguards in place to help protect your Personal Information, and our store platform and payment partners maintain their own security and fraud prevention systems. No system can guarantee complete security, and third party viruses or security failures may result in Personal Information being compromised. You can help by using antivirus software, creating strong passwords, and limiting access to your devices. In the unlikely event that your Personal Information is compromised due to a security breach on our end, we will notify you in accordance with applicable law as soon as reasonably possible.
Protection of Children
Our Online Services are intended for a general audience and are not directed to children under the age of 13. We do not knowingly collect Personal Information from children under 13, and we will delete such information promptly if we become aware of it. If you believe a child under 13 has provided us Personal Information, please contact us using the information at the end of this Policy.
Changes Made to This Policy
We may modify this Policy from time to time. The date at the top of this Policy shows when it was last revised. By continuing to access or use our Online Services after a change, you agree to the updated Policy, so it is worth checking back occasionally.
Dispute Resolution
We will always try to resolve your concerns about our privacy practices promptly, and we hope we can find a solution together without costly legal channels. If we cannot reach an agreement, by using our Online Services you agree to resolve the matter through the dispute resolution terms in our Terms, including mandatory binding arbitration administered in Travis County, Texas and a class action waiver. THE DISPUTE RESOLUTION TERMS IN OUR TERMS MATERIALLY AFFECT YOUR ABILITY TO BRING A LAWSUIT AGAINST US. PLEASE READ THEM CAREFULLY.
Additional Terms and Entire Agreement
This Policy is subject to the terms stated in our Terms, including all clauses regarding warranties, limitation of liability, indemnification, assignment, waiver, severability, applicable law, jurisdiction, and any other provisions that logically ought to apply to this Policy. This Policy and our Terms represent the entire and exclusive agreement between you and us regarding our Online Services, and they supersede all previous written and oral agreements and communications on this subject.
